Electro-intensive Consumer Aid: advisory
Advice and assistance for energy-intensive consumers
Subsidies to energy intensive consumers are a reality and can cover up to 85% of the costs of financing renewable energy. From Trébol Energía we offer the energy consultancy necessary for our customers to meet the requirements for this aid in accordance with the Royal Decree 1106 / 2020 that regulates them.
What are electro-intensive consumers?
An electro-intensive consumer is a company with high electricity consumption whose activity depends significantly on energy costs to remain competitive. These companies typically belong to energy-intensive industrial sectors, where electricity accounts for a substantial share of production costs.
The electro-intensive consumer category is designed to identify companies that, given their consumption levels and exposure to energy prices, may qualify for certain support measures, compensation mechanisms or energy optimisation strategies.
Which companies can be considered electro-intensive
In general, a company can be considered electro-intensive when it meets a combination of requirements relating to:
high annual electricity consumption
a high share of energy cost relative to production value
belonging to industrial sectors with high energy dependence
meeting specific regulatory and administrative criteria
adopting energy efficiency or sustainability commitments, where regulations require it
Using a lot of electricity is not enough on its own. Electro-intensive status also depends on the activity, the weight of energy in the company's costs and the applicable regulatory framework.
What are the advantages of being an electro-intensive consumer
Being recognised as an electro-intensive consumer can bring significant advantages to a company:
access to cost support or compensation mechanisms
improved industrial competitiveness
reduced exposure to electricity market volatility
energy procurement strategy optimisation
the option to structure more efficient energy contracts
greater ability to plan costs over the medium and long term
In a volatile price environment, this arrangement is particularly relevant for companies that need predictability and stability in their electricity costs.
Which sectors are typically electro-intensive
Electro-intensive consumer status is common in industrial sectors where electricity is critical to production, such as:
metallurgy and steelmaking
química industrial
paper and cardboard
ceramics and construction materials
vidrio
aluminium industry
continuous industrial processes
certain high-consumption agri-industrial activities
Each case must be assessed individually, since consumption volume alone does not always determine eligibility.
Difference between a large energy consumer and an electro-intensive consumer
Not every large energy consumer is necessarily an electro-intensive consumer.
A large energy consumer is, broadly speaking, a company with high energy consumption. An electro-intensive consumer, by contrast, is a narrower category tied to electricity consumption and to a set of technical, financial and regulatory requirements.
In other words:
large energy consumer → broad concept
electro-intensive consumer → a regulated, narrower category
This distinction is crucial when assessing grants, accreditations and energy purchasing strategies.
How to tell whether a company qualifies for this status
To determine whether a company can be considered electro-intensive, it is worth analysing:
its annual electricity consumption
the energy cost structure
the sector of activity
the CNAE code
the regulatory requirements in force
the available technical and financial documentation
This analysis establishes eligibility and defines the best strategy for optimising energy costs.
Energy consultancy for electro-intensive consumers
Electro-intensive companies usually need a specific energy strategy. This includes:
consumption profile review
analysis of network charges, capacity and tariff structure
electricity procurement optimisation
assessment of bilateral contracts or PPAs
study of compensation, hedging and market risk
regulatory and documentary compliance
Specialist energy management can make a real difference to a company's competitiveness and financial stability.
Subsidies for electro-intensive consumers
In line with Royal Decree-Law 20/2018 on urgent measures to boost economic competitiveness and Royal Decree-Law 24/2020 on social measures to reactivate employment and industrial competitiveness, the Spanish Government issued Royal Decree 1106/2020, which constitutes the Statute of Electro-Intensive Consumers.
electro-intensive consumer aid: features
It sets out the support and financial subsidies available to companies certified as electro-intensive consumers. Broadly, these take the form of financial compensation, but there are further benefits — among them access to a risk hedging mechanism backed by the Spanish Reserve Fund for Guaranteeing Electro-Intensive Entities (FERGEI).
Regarding the economic compensation, some points stand out. As established in Title III of the Royal Decree, the objective is to compensate "up to 85% of the costs on the specific retribution to renewable energies and high efficiency cogeneration, and of the specific retribution in non-peninsular territories". Furthermore, this aid may be cumulative with other aid corresponding to the purpose of compensating the costs related to the emission of greenhouse gases, either directly from the EU or from other public administrations.
How to access aid for electro-intensive consumers?
To access aid intended for energy-intensive consumers, beneficiary companies must have the appropriate certification.
Requirements for certification of electro-intensive consumers
The regulations establish general requirements for obtaining certification as energy-intensive consumers. These are:
Company owning the installation or supply point constituted in the correct way, according to the regulations in force.
Belong to one of the sectors or subsectors included in the codes of the National Classification of Economic Activities CNAE.
To have an annual electricity consumption volume of more than 1GWh, for at least two of the three years prior to the application for certification. As well as having consumed at least 50 percent of the energy during off-peak hours.
To have the energy contracted directly on the electricity production market, depending on the modality of choice, but duly provided for by the regulations.
To have a ratio, for at least two of the three previous years, higher than 1.5KWh/€ between the annual consumption and the gross added value of the installation corresponding to the supply point, according to the respective category.
Application for certification of energy-intensive consumers in the energy-intensive industry
As for the application process, it must be completed electronically, and the Royal Decree establishes the steps to be followed by companies belonging to the electricity-intensive industry:
Submit the corresponding application to the Spanish Ministry of Industry, Trade and Tourism.
Attach the required documentation: electronic questionnaire, powers of attorney for the signatories, the corresponding audit report, among others.
Await the response from the Directorate-General for Industry and Small and Medium-Sized Enterprises, whether approving the application or requesting corrections to a document or procedure.
The certification of energy-intensive consumers, which is particularly relevant for the energy-intensive industry, must be renewed annually before April 30.
Obligations of electro-intensive consumers
The regulation establishes that energy-intensive consumers have obligations in different areas.
In terms of consumption, it implies having a predictable consumption that can be verified by the System Operator.
Regarding energy management and energy efficiency, it is mandatory to submit a report to the Ministry of Ecological Transition and Demographic Challenge on electricity consumption, relevant production and implemented measures.
In terms of contracting, they require that at least 10% of the annual consumption, after accessing the benefits, comes from electricity of renewable origin.
In matters of employment and productive activity requiring compliance with Article 5 of RD-Law 20/2018.
Failure to comply with any of the obligations contained in articles 10, 11, 12 and 13 of RD 1106/2020 is sufficient cause for loss of certification.
Electrointensive Production Factor:
Electricity, as an electro-intensive production factor, stands out as an essential element for certain economic sectors. Companies that meet the requirements and obtain certification as electro-intensive consumers benefit not only from financial aid, but also from a status that recognizes the critical importance of electricity in their production processes. This special recognition helps strengthen the competitiveness and economic development of these companies by mitigating the costs associated with their high electricity consumption, thus promoting their contribution to the country's economic fabric.
