Advice and assistance for energy-intensive consumers
Subsidies to energy intensive consumers are a reality and can cover up to 85% of the costs of financing renewable energy. What are electro-intensive consumers?
Electro-intensive consumers are those companies that use electricity as a key production factor. Consequently, the costs of this use represent high figures, which have a direct impact on their economic development, competitiveness and, in itself, on the country's economy.
Subsidies for electro-intensive consumers
In accordance with Royal Decree-Law 20/2018 on urgent measures to boost economic competitiveness and Royal Decree-Law 24/2020 on social measures to revive employment and competitiveness in the industrial sector, the Spanish Government issued Royal Decree 1106/2020, which constitutes the Statute of Energy-Intensive Consumers.

This establishes the financial support and subsidies available to companies that are certified as electricity-intensive consumers. In general, the contributions take the form of financial compensation, but there are other benefits such as access to a risk coverage mechanism backed by the Spanish Reserve Fund for Guaranteeing Electricity-Intensive Entities (FERGEI).
Regarding the economic compensation, some points stand out. As established in Title III of the Royal Decree, the objective is to compensate "up to 85% of the costs on the specific retribution to renewable energies and high efficiency cogeneration, and of the specific retribution in non-peninsular territories". Furthermore, this aid may be cumulative with other aid corresponding to the purpose of compensating the costs related to the emission of greenhouse gases, either directly from the EU or from other public administrations.
How to access aid for electro-intensive consumers?
To access aid intended for energy-intensive consumers, beneficiary companies must have the appropriate certification.
Requirements for certification of electro-intensive consumers
The regulations establish general requirements for obtaining certification as energy-intensive consumers. These are:
- Company owning the installation or supply point constituted in the correct way, according to the regulations in force.
- Belong to one of the sectors or subsectors included in the codes of the National Classification of Economic Activities CNAE.
- To have an annual electricity consumption volume of more than 1GWh, for at least two of the three years prior to the application for certification. As well as having consumed at least 50 percent of the energy during off-peak hours.
- To have the energy contracted directly on the electricity production market, depending on the modality of choice, but duly provided for by the regulations.
- To have a ratio, for at least two of the three previous years, higher than 1.5KWh/€ between the annual consumption and the gross added value of the installation corresponding to the supply point, according to the respective category.
Application for certification of energy-intensive consumers in the energy-intensive industry
As for the application process, it must be completed electronically, and the Royal Decree establishes the steps to be followed by companies belonging to the electricity-intensive industry:
Address the respective request to the Ministry of Industry, Commerce and Tourism.
Attach the required documentation: electronic questionnaire, powers of attorney of the signatories of the application, corresponding audit report, among others.
Wait for a response from the Directorate-General for Industry and Small and Medium-Sized Enterprises, whether it is positive or to correct any documents or procedures.
The certification of energy-intensive consumers, which is particularly relevant for the energy-intensive industry, must be renewed annually before April 30.
Obligations of electro-intensive consumers
The regulation establishes that energy-intensive consumers have obligations in different areas.
- In terms of consumption, it implies having a predictable consumption that can be verified by the System Operator.
- Regarding energy management and energy efficiency, it is mandatory to submit a report to the Ministry of Ecological Transition and Demographic Challenge on electricity consumption, relevant production and implemented measures.
- In terms of contracting, they require that at least 10% of the annual consumption, after accessing the benefits, comes from electricity of renewable origin.
- In matters of employment and productive activity requiring compliance with Article 5 of RD-Law 20/2018.
Failure to comply with any of the obligations contained in articles 10, 11, 12 and 13 of RD 1106/2020 is sufficient cause for loss of certification.
