Call for aid to the gas-intensive industry approved

 

The BOE has recently published in the Official State Gazette the definitive rules for the line of aid for the compensation of additional costs due to the exceptional increase in natural gas prices(GASINTENSIVOS).

 

The purpose of this call is to mitigate the impact on industries of part of the additional costs due to the exceptional increase in the price of natural gas.

The application period will begin on July 27 and end on August 24, 2023, inclusive.

This line of aid will allow industries that meet the requested requirements to receive compensation to balance the increase in the price of natural gas during 2022.

 

What are the eligibility requirements for aid to the gas-intensive industry?

 

To be eligible for these grants, the following requirements are desired:

  1. To carry out the activities corresponding to the codes(CNAE) included in the annex to Royal Decree-Law 20/2022, of December 27.
  2. To have consumed more than 1.5 GWh of natural gas per year during at least one of the two years prior to the call for applications.

 

Annual gas consumption and annual gross value added

 

In addition, it will be necessary to prove that the quotient between the annual consumption of natural gas and annual gross value added GVA of each of the facilities operated by the beneficiary for which the aid is requested has been equal to or greater than 1.5 kWh/€ during at least one of the two years prior to that of the call.

The concept of GVA is defined and calculated as gross value added at factor cost, i.e. GVA at market prices less indirect taxes, plus any subsidies. Gross value added at factor cost can be calculated from turnover, plus capitalized production, plus other operating income, plus or minus changes in inventories, minus purchases of goods and services, minus other taxes on products linked to turnover but not deductible, minus duties and taxes linked to production.

 

GVA may also be calculated on the basis of gross operating surplus plus personnel costs. Value added excludes income and expenses classified as financial or extraordinary in the company's accounts. Value added at factor cost is calculated at the gross level, as value adjustments (such as depreciation) are not subtracted.

 

In summary, the "Gross Value Added" corresponds to the difference between the value of production and the value of consumption, the calculation would be as follows:

What documentation must gas intensive companies submit?

The documentation to be submitted in order to be eligible for the grants is as follows:

  • Gas bills 2021 and 2022
  • EBITDA for the years 2020 and 2021
  • Production in tons of each product included in these activities during the year 2022

 

How do I apply for aid to the gas-intensive industry?

 

The eligible period is the period between 01/02/2022-31/12/2022. To apply for the aid the gas-intensive company must present:

  1. Electronic application form
  2. Explanatory report of the activities carried out in each of the facilities included in the application.
  3. Report verified by an entity that certifies the part of gas consumption(This report must be prepared by a verifier accredited in the emissions trading scheme by the National Accreditation Entity (ENAC).
  4. Auditor's report to certify:
    • The average price of natural gas, in €/MWh, supported by the applicant during each of the eligible and reference periods. If the thermal energy used in the industrial installation comes from another installation that is not eligible for this aid, the average price of this thermal energy, in €/MWh, supported by the applicant during each period must be certified. The verification of the average price of natural gas supported by the applicant legal entity must be carried out taking into account all the natural gas consumed in all its facilities, even in ineligible activities, and based on accounting statements and invoices or other documents that allow accrediting the volume of natural gas consumed by the company, as well as its price.
    • The gross value added(GVA) of each of the facilities during the years 2021 and 2022. For facilities with less than two years of operation, only the gross value added for the year 2022 will be included.
    • The EBITDA of the applicant legal entity during the eligible period(01/02/2022-31/12/2022) and the reference period(01/02/2021-31/12/2022), in case the applicant wishes to qualify for the higher aid threshold defined in section six.2.
